As provided for by the North American Free Trade Agreement (NAFTA), the TN work visa status is offered to Mexican and Canadian citizens who are seeking to enter the U.S. to work at a professional level. A “professional level” is work that requires a bachelor's degree (or higher) or credentials such as a professional license. Four types of visas are dealt with by the NAFTA agreement:
B–1 visas for temporary visitors for business
E–1 and E–2 visas for “treaty” traders and investors
L–1 visas for intracompany transferees, and
TN visas for professional level employees
The TN category also permits U.S.-based employers to sponsor a Mexican or Canadian citizen lacking a degree or a professional license, provided the employee will work as a technician in direct support of professionals. There is no cap on TN visas. To apply for a TN visa, a sponsored employee must prove Mexican or Canadian citizenship; must prove that he or she will work in a position on the TN listing of occupations; and show that he or she has the education or work experience that the job requires.
