The L-1, O-1, and P-1 visas are among the work visas commonly held by foreigners working in the United States. Determining which visa is appropriate for any individual is often tricky and always difficult. Los Angeles immigration visas lawyer Patricia Depew helps employees and their employers choose the right options by providing them with sound, experienced legal counsel and representation. Her comprehensive immigration practice includes family-based immigration, business and employment immigration, and investment and trader visas. Ms. Depew also represents clients before the Bureau of Citizenship and Immigration Services (formerly the INS) and U.S. Immigration Court.
The Different Visas
The P-1 is made available to internationally recognized athletes or members of an entertainment group. Each year, no more than 25,000 P visas are granted. An athlete entering the United States for an individual competition event (rather than a team event) must demonstrate that he or she is internationally recognized. Entertainers must be part of a group; individual performers cannot typically obtain a P-1 except to join others in his or her entertainment group already in the United States.
An L-1 visa is a non-immigrant work visa valid for only a brief period of time, sometimes as little as three months. With extensions, however, the stay can be extended to seven years. Large employers may be able to apply for “blanket” L-1 petitions rather than filing single petitions for each prospective employee.
The O-1 nonimmigrant visa is designed for foreign nationals recognized for having extraordinary ability in the arts, sciences, athletics, education, or business, or for anyone with a demonstrable record of nationally or internationally recognized achievement in the television or motion picture industry. The O-1A visa is for individuals with exceptional abilities in science, education, business, or athletics. The O-1B visa is for individuals with exceptional abilities in the arts or extraordinarily high achievements in the motion picture industry or the television industry.
