Temporary non-immigrant visas are available to persons who want to work in the U.S. for a definite, short period. These visas are available for healthcare professionals, artists, athletes, scholars, professionals, and business people. Non-immigrant work visas include:

B-1 Temporary Visitor for Business: The B-1 allows foreign nationals to visit the U.S. on business. It does not allow immigrants to work within the U.S. for U.S.-based employers.

H-1B Specialty Occupations: The H-1B allows foreign nationals up to six years in the U.S. in specialty jobs. Visa holders must have a bachelor’s degree or its equivalent.

L-1 Intra-Company Transfers: The L-1 lets a company transfer to the U.S. employees in positions that are managerial, executive, or require specific knowledge.

O-1 Extraordinary Ability: The O-1 is available to those with extraordinary abilities in education, business, science, athletics, the arts, or film and television production.

Employment-based Immigration

Immigrants may also work in the U.S. as permanent residents. Employer sponsorship is required in some cases. In addition to business immigration, permanent employment-based immigration is split into five preference categories:

First Preference: EB-1 Priority Workers: EB-1 includes foreign nationals with extraordinary abilities in the sciences, arts, education, business, or athletics; outstanding professors or researchers; and multinational corporate executives and managers.

Second Preference: EB-2 Professionals with Advanced Degrees or Exceptional Ability

Third Preference: EB-3 Skilled or Professional Workers

Fourth Preference: EB-4 Special Immigrants (charity or religious workers)

Fifth Preference: EB-5 Investor Immigrants
